Cry out in anger at Egypt’s show trials

A CALL FOR SOLIDARITY:

The US-backed regime of Hosni Mubarak is prosecuting 49 Egyptians in the Emergency High State Security Criminal Court. It is accusing them of involvement in the recent two day uprising in the Nile Delta town of Mahalla.
Egyptian security forces occupied Ghazl el-Mahalla, the biggest textile mill in the Middle East with 27,000 workers, on the 6 and 7 April.
They were attempting to crush a strike in protest against skyrocketing food prices. The workers also demanded a raise in the national minimum wage, which has remained stagnant since 1984.
The strike was organized by the Textile Workers’ League, an independent labor association formed last year following a wave of successful textile workers’ occupations.
The association called the strike on 6 April. The regime responded by flooding the Nile Delta town with thousands of troops. They surrounded the textile factory compound.
This move triggered a mass demonstration that drew in workers and the urban poor.
Protesters fought back when security forces attacked demonstrators with batons, tear gas, water cannons, rubber bullets and live ammunition.
Crackdown
At least three people were killed and hundreds injured. Police then swooped on neighborhoods and arrested hundreds of Mahalla citizens, including key strike activists.
Many of these activists were released following international pressure, but 43 ordinary people swept up in the crackdown are still in jail.
Detainees who were released shortly afterwards spoke of horrific torture meted out to them in police stations and state security facilities.
These included severe beatings, electric shocks and sexual abuse. Prisoners were forced to sleep on the floor and threatened with rape. On several occasions security forces personnel trampled over the detainees as they lay helpless on the ground.
The detainees have found themselves trapped in a maze of laws and prisons.
State security agents have ignored orders from the prosecutor’s office to release some of the prisoners.
Others who had made it out of the detention facilities were either kidnapped or rearrested under wide-ranging security powers.
Mubarak’s regime has decided to transfer 43 of the detainees to an exceptional court – which has been denounced by human rights groups as lacking the international standards for a “safe and just trial”.
Six others are on the run and will be tried in absentia.
All the detainees will be tried on trumped up charges and face prison sentences of between six to ten years hard labor.
Egyptian activists have denounced the regime for using the detainees as scapegoats for the uprising. The trial is expected to begin in August.
International solidarity with the Mahalla detainees is urgently needed. Statements of support from trade unions and human rights groups will help put pressure on the Egyptian dictatorship.

That on 6th and 7th April 2008, in the 1st and 2nd Districts of Mahalla, Gharbeia Governorate
a. Defendants numbers 1 – 41
Took part, with other unknown people, in a riotous assembly composed of more than five persons of a nature to endanger the general peace. The aim of the riotous assembly was to commit theft and ransacking using force and violence. When arrested some of them were carrying firearms and others were carrying instruments of a nature to cause death if used as weapons. Defendants numbers 1 – 10 planned this riotous assembly, and the following crimes were committed with the intention of carrying out the intended and deliberate aim of this riotous assembly:
1. Deliberate destruction of buildings and public property (the Taha Hussein and Abdel Hay Khalil Schools, the El-Shoun post office, the El-Alw traffic and emergency response post, the El-Shoun Square Services Office). The operations of these public offices were hindered as a result, and people’s lives and wellbeing endangered. LE 9,526,504.50 (nine million, five hundred and twenty six thousand, five hundred and four pounds, and fifty piastres) worth of damage were caused in the manner established in the investigations…
2. Deliberate starting of fires in the Taha Hussein and Abdel Hay Khalil Schools and the El-Alw traffic and emergency response post. They threw burning bottles [Molotov cocktails] and as a result fire spread the contents of these buildings and burnt them in the manner established in the investigations…
3. Endangering and delaying of land transport vehicles. They set fire to rubber tyres and placed them in the middle of the road and on the railway tracks. Train driver Ahmad Hussein Ismail Gamal Eddin received the injuries described in the medical report attached to the papers as a result of this and had to receive 20 days of medical treatment. This occurred in the manner established in the investigations…
4. Deliberate damage of the property of telephone networks (Menatel, El-Nil and El-Masreyya Lel Ittisalaat telephone booths ) built using public funds and described and valued in the reports. As a result of this calls [from these booths] were cut off in the manner established in the investigations…
5. Acting as a gang, they damaged and ransacked the contents of the Abdel Hay Khalil, Taha Hussein and Omar Za’faan Schools, El-Alw emergency response post, telephone boxes owned by the Menatel, El-Nil and El-Masreyya Lel Ittisalaat companies, the El-Alw Emergency response and traffic post, Silver for Shoes shops , Awlaad Raslaan, Naseer Zaqzooq, the El-Shafei Pharmacy, a shop owned by Fatma Ibrahim Khareesa, Nosf El-Donya, the Ahmad Muhammad Photography Studio, Hassan Abdel Moneim’s Wedding Dress Rental shop, Muhammad Mahmoud Salah’s Wedding Gown Rental shop, Yosry El-Gazar’s confectionary shop, Fina Copy Center and Atef Ilyas’ jewellery shop. This was carried out using force in the manner established in the investigations…
6. They deliberately damaged:
a. Private equipment, tools and handicrafts, some lampposts and the footbridge intended for the benefit of the public in the streets and public squares of El-Mahalla El-Kobra. This resulted in LE 60,857,25 (sixty thousand, eight hundred and fifty-seven and twenty-five piastres) worth of damage in the manner established in the investigations…
b. Fifty cars owned by the police, the governorate and the emergency services. This resulted in LE 287,530 (two hundred thousand, five hundred and thirty) worth of damage in the manner established in the investigations…
c. Twenty cars and twelve buses owned by the Mahalla El-Kobra local transport authority. This caused LE 14,670 (fourteen thousand, six hundred and seventy) worth of damage in the manner established in the investigations…
d. Shop fronts of the El-Watany Development Bank, Alexandria Bank, the 23 July branch of the Egypt Bank, and the Mahalla branch of the Cairo Bank, the Egypt for Islamic Transactions Bank and two ATMs owned by two other banks. This resulted in 209538,28 (two hundred and nine thousand, five hundred and thirty eight hundred pounds and 28 piastres) worth of damage in the manner established in the investigations…
e. Eight trains and the Mahalla El-Kobra electricity box. They threw stones at them leading to the damages described in the railway engineer’s report. 56,540,40.08 (fifty six thousand, five hundred and forty pounds and 20 piastres) worth of damage in the manner established in the investigations…
f. A private car owned by Rehab Mahmoud El Gazar (registration: 74994 Malaky El-Gharbeia) and two cars owned by Ghaaz Misr Company (registration: 23342 naql El-Gharbeia and 24168 naql El-Gharbeia). This resulted in material damage to the vehicles’ owners of over fifty pounds in the manner established in the investigations.
As a result of the crimes described above the provision of public services was delayed and people’s lives and well being endangered in the manner established in the investigations.
7. They assaulted the policemen named in the investigations and resisted them using force and violence during the policemen’s carrying out of their duties, namely the preservation of order and security. They fired gunshots at them and pelted them with stones and lit bottles [Molotov cocktails]. This resulted in their receiving the injuries described in the medical reports attached which required no more than twenty days of medical treatment except for the first [policeman] who required more than twenty days, in the manner established in the investigations…
8. They stole a walkie-talkie in the possession of officer Muhammad Ahmad Qa’ood. Some of them were carrying weapons at the time. This took place in one of the streets in Mahalla El-Kobra in the manner established in the investigations…
9. Illegal possession of [incomprehensible word] firearms (four locally-made bullet cartridges) in the manner established in the investigations…
10. Illegal possession of ammunition used in the weapons described in the previous charge in the manner established in the investigations…
11. Possession of tools used to assault people (stones, bottles and sticks) in the manner established in the investigations…
12. They threw stones at trains and railway property (the Mahalla electricity box) and endangered the passage of trains by putting burning tyres on the tracks in the manner established in the investigations…
b. Defendants 42 – 49
Took part, with the other defendants described above and other unknown individuals, in the riotous assembly described in the first charge. They were ordered to disperse by the police and refused to submit to them. They did not obey their orders in order to carry out the following crimes…
Defendant 42
Stole the weapon in the possession of Sergeant Ahmad Muhammad Abdel Wahed. He joined other unknown individuals who gathered around him [Abdel Wahed] and physically assaulted him, enabling them in this way to force him to give in and they appropriated the weapon previously mentioned as well as ammunition without a licence . This occurred in one of Mahalla El-Kobra’s streets in the manner established in the investigations…
Defendants 43 – 49
Joined with defendants 1 – 41 in ransacking the Abdel Hay Khalil and Taha Hussein Schools and telephone boxes owned by the Menatel, El-Nil and El-Masreyya Lel Ittisalaat companies as well as advertisements and propaganda [the exact translation is ‘guidance’] posters , using force in the manner established in the investigations…

On the basis of this
The defendants have committed crimes under [lists articles].
And for this reason
After examining Presidential Decree 167 [year 1958] on the State of Emergency and Presidential Decree 560 [year 1981] on the Declaration of a State of Emergency and Presidential Decree 121 [year 2006] on the Extension of the State of Emergency and Presidential Order 1 [year 1981] on the transfer of certain crimes to State Security Courts, I order:
1. The transfer of the case to the Supreme State Security Emergency Court based in the Tanta Appeals Court…The preventative detention of defendants 1, 3, 4, 6, 9, 11, 12, 13, 14, 15, 17, 21, 26, 27, 28, 32, 42, 43, 44, 45, 46, 48 and 49 is hereby extended. Defendants 5, 8, 10, 22 and 23 are to be apprehended and detained in custody during the course of investigations.

Mahalla Updates

The following documents are the Tanta Prosecutor’s orders to refer 49 Mahalla citizens to the Criminal High State Security Emergency Court, facing a variety of accusations including: illegal assembly, disturbing public order, blocking railway lines, refusing to obey the police orders to disperse, destruction of private and public property, possession of unlicensed firearms.

اعلن اليوم 2 من معتقلى برج العرب السياسيين و17 من الجنائيين على خلفية احداث 6 ابريل اضرابا مفتوحا عن الطعام احتجاجا على استمرار اعتقالهم رغم حصولهم على قرارات قضائية بأخلاء سبيلهم الا ان وزارة الداخلية اصدرت قرارات اعتقال بشأنهم ومن اشهر الوجوه التى ستعلن الاضراب غدا المدون المصرى محمد مرعى الطالب بكلية طب المنصورة والذى كان قد تم اعتقاله فى 10 ابريل الماضى اثناء قيامة بعمل لقاءات صحفية مع اهالى المعتقلين وبصحبتة الصحفى الامريكى جيمس باك الطالب فى جامعة كالفورنيا والذى كان قد تم القبض عليه ولكن بعد يوم تم اطلاق سراحة واصدار قرار اعتقال لمرعى .
وكنت قد تقابلت مع مرعى اثناء اعتقاله وعلمت انه تم وضعه مع الجنائيين فى بادىء الامر ولقى معاملة مهينة جدا وصلت لقيام الحرس بتجريدة من ملابسة بالكامل وعندما طلب مرعى اعتذار الضابط على معاملتة بهذا الشكل اخبره الضابط ان هذه هى معاملة الجانئيين داخل السجن فقرر مرعى الاضراب عن الطعام حتى تم نقله الى السياسى ومازال مرعى حتى الان خلف اسوار سجون برج العرب ينتظر مصيره هو وباقى المعتقلين رغم قيام وزارة الداخلية بالافراج عن كل المعتقلين فى احداث 6 ابريل مما يؤكد انه ليس هناك اى مبرر من استمرار اعتقال مرعى حتى الان بالاضافة الى حرمان مرعى من دخول امتحناته بعد ان قال له الدكتور انه لن ينجح مهما فعل
ولم يكن مرعى وحده اشهر الوجوه التى مازالت ببرج العرب بل هناك ايضا والذى سيشارك فى الاضراب الكاتب الروائى مسعد ابو فجر التى قامت قوات امن الدولة بالاسماعلية بأعتقالة فى شهر ديسمبر الماضى ورغم حصولة على حكم قضائى اواخر الشهر الماضى الا ان وزارة الداخلية اختطفته ما يقرب من 10 ايام فى احدى نقاط الشرطة الموجودة بالعريش ثم اعادته مرة اخرى بقرار اعتقال جديد الى سجون برج العرب يذكر ان ابو فجر من مؤسسى حركة ودنا نعيش التى تهتم بمشاكل اهالى سيناء
وعلى الجانب الاخر اذدادت حالة الاحتقان فى الشارع المحلاوى بعد ان اصدر

بعد ان وجهت لهم التحقيقات تهم مختلفه يوم 6 و 7 ابريل 2008 بدائرة قسم اول وثان المحلة بمحافظة الغربية وكانت الاتهامات من المتهم الاول حتى الحادى واربعين هى اشتراك المتهمين مع اخرين مجهولين فى تجمهر مؤلف من اكثر من خمسة اشخاص من شأنه جعل السلم العام فى خطر وكان الغرض منه ارتكاب جرائم السرقه والنهب مستعملين فى ذلك القوة زالعنف وحال كون بعضهم يحمل اسلحه ناريه والبعض الاخر يحمل الات من شأنها احداث الموت اذا استعملت بصفة اسلحة وقد احتوى قرار الاحالة على ان المتهمين خربوا عمدا مبانى واملاك عامه مثل مدرستى طه حسين وعبد الحى خليل بالاضافة الى متب بريد الشون ونقطة اسعاف ومرور العلو ومكتب خدمة الجماهير بميدان الشون واحداث اضرار ماديه
قميتها 9526504.50 جنيها بالاضافة الى وضع النار عمدا فى المدارس السابقة ومرور اسعاف العلو عن طريق القاء الزجاجات الحارقه كما قامو بتعريض وسائل النقل للخطر وعطلوا سيرها عن طريق اشعار النار فى اطارات الكاوتشوك ووضعوها فى نهر الطريق وعلى خطوط السكك الحديديه وقد نشأ عن ذلك اصابه احمد اسماعيل جمال الدين سائق قطار ولم يكن هذا هو فقط الاتهام التى وجهته التحقيقات وانما اختلفت بين تخريب سيارات واتلاف عمد للمتلاكات العامة والخاصة
اما المتهمون من الثانى واربعين وحتى الاخير وجهت لهم التحقيقات اشتراكهم من المتهمين سالفى الذكر واخرين مجهولين فى التجمهر موضوع التهمه الاولى وقد امرهم رجال السلطة بالتفرقه فرفضوا اطاعة الاوامر وقاموا بارتاكب الجرائم حيث قام المتهم الثانى والاربعين حسب الاتهام بسرقة سلاح ميرى عهدة العريف احمد محمد عبد الواحد بطريق الاكراه بعض الانضمام مع اخرين مجهولين وتجمعوا حلوه وتعدوا عليه بالضرب فتمكنوا بهذه الوسيله من الاكراه من شل مقاومته والاستيلاء على السلاح اما المتهمين من الثالث واربعون حتى الاخير وجهت لهم تهم الانضمام الى المتهمين من واحد حتى الحادى واربعين فى نهب المدارس السابقة وبعض كبائن التليفونات الخاصة بالشركة المصرية للاتصالات والنيل وميناتل وبعض اللافتات الاعلانية والارشادية وذلك بالقوة الاجبارية على النحو السابق للتحقيقات
وقد استند المحامى العام فى قرار الاحالة الى بعض مواد القانون وقرار رئيس الجمهورية رقم 162 لسنة 58 بشأن حالة الطوارىء وقرار رئيس الجمهورية رقم 560 لسنة 1981 بأعلان حالة الطوارىء وقرار رئيس الجمهورية رقم 121 لسنة 2006 بمد حالة الطوارىء وامر رئيس الجمهورية رقم 1 لسنة 1981 بأحالة بعض الجرائم لمحاكم امن الدولة طوارىء وبناء على القرارات السابقة قرر المحامى العام لنيابات شرق طنطا احالة القضية الى محكمة جنايات امن الدولة العليا طوارىء وفقا لامر الاحالة وقائمة ادلة الثبوت المرفقين مع استمرار حبس المتهمين احتياطيا وهم الاول والثالث والرابع والسادس والتاسع والحادى عشر والثانىعشر والثالث عشر والرابع عشر والخامس عشر والسابع عشر والحادى والعشرين والسادس والعشرين والسابع والعشرين والثامن
وكان قد تسبب قرار الاحالة فى ثورة عارمة فى المحكمة وسط ذهول الاهالى الذين توجهوا الى المحكمة على امل ان يطلق صراح اولادهم الابرياء وهذا ما لم يحدث وفى لقاء لاخوان اون لاين مع احمد حجازى عضو هيئة الدفاع عن متظاهرى 6 ابريل يقول انه يثق فى قضاء مصر العادل الذى سيكشف بالتأكيد تلفيق القضاية والتى اظهرت هيئة الدفاع البعض منها ومن احدى القضايا التى ظهر التلفيق تلك التى وجهت لعصام الغره المتهم رقم 26 بتحريز اجهزة كمبيوتر فى منزلة بمساكن كفر حجازى علما بأن عصام يسكن بمنطقة الجمهورية وقد ترك مسكنه بمساكن كفر حجازى منذ اكثر من 10 سنوات ولكن لان المحاضر ملفقة فقد قام الضابط الذى حرر المحاضر بكتابة عنوان عصام الموجود فى البطاقة دون ان يرى ان كان عصام يسكن فى هذا العنوان فعلا ام لا مما يظهر بأن المحضر تم تلفيقة وهناك الكثير ايضا من المحاضر التى يظهر فيها التلفيق واكتفى حجازى فى حديثة بتأكيده ان قضاء مصر العادل سينطق بالبراءه لان المتهمين فعلا ابرياء على حد قوله وعن جلسة الحكم بعد قرار الاحالة يقول حجازى انه حتى الان لم يتم تحديد موعد للجلسة الا انه يتوقع ان تكون فى القريب العاجل
وعلى هامش قرار الاحالة اصدر المحامى العام قرارا بحفظ القضية الخاصة بمعتقلى 6 ابريل الذى تم اطلاق سراحهم الفترة الماضية
